Terms and conditions of entering prize draws

Flaschenpost Services Ltd., with legal seat in Zurich, (hereinafter «FS»), is organizing a prize draw on the social network www.instagram.com/flaschenpost.ch (hereinafter «Instagram»). These conditions of participation govern the rights and obligations of the participants in this prize draw (hereinafter collectively the «Participants»).

1 Participation

Participation in the prize draw takes place by subscribing to the FS Instagram account. Participants may only participate in the prize draw once. Participation is limited to natural persons with unlimited capacity to act who are over 18 years of age and reside in Switzerland or the Principality of Liechtenstein. The winner of the prize will be drawn at random and notified personally. The closing date for the prize draw is 17.06.2022. Legal action is excluded, and no correspondence will be entered into regarding the prize draw. Prizes including vouchers and any non-cash prizes cannot be paid out in cash or exchanged. Sale, auction and any other transfer of prizes for a fee are prohibited. Participation with false, falsified, or incomplete information, such as fictitious or only temporarily used e-mail addresses, falsified accounts, as well as by means of entry services, scripts, and comparable means, such as technical manipulation, is prohibited. Participants who take part in the prize draw using such information or such means shall be fully liable for all damages incurred by FS as a result. Any liability of FS for direct or indirect damages arising from the prize draw, from the receipt of the newsletter and in any other connection with the prize draw is expressly and completely excluded, subject to mandatory legal provisions. In particular, FS shall not be liable for the temporary or permanent partial or complete unavailability of the prize draw or for errors in the prize draw. Instagram and Facebook are exempt from any responsibility, neither involved in the prize draw nor the organizers.

2 Data protection

FS is subject to Swiss law on data protection. FS collects for the prize draw in particular those data that participants submit to participate in the prize draw with their account information via Instagram and Facebook, as well as data that is necessary for the payment of the prize. Further data such as date and time stamps, IP addresses used, information on the browsers and operating systems used as well as, if applicable, released location information accrue to FS through the use of the website. FS may use all collected data for any purpose in connection with the prize draw and pass it on to the partners, in each case in particular also for sending out newsletters. FS shall take appropriate measures to protect all data collected and shall not pass on any data to other third parties. FS is authorized to transfer or have transferred personal data and other collected data of the participants to contractors - for example to providers for the newsletter dispatch - in the context of exercising or transferring rights and obligations arising from these conditions of participation as well as in connection with the prize draw. In the event of any commissioned data processing abroad, FS shall take appropriate measures to ensure a data protection standard comparable to that in Switzerland. The website uses cookies, i.e. in particular small text files that are permanently or temporarily stored on the participants' computers when they use the website. The purpose of the cookies is in particular the analysis of the use of the website for statistical evaluation as well as for continuous improvements. Participants can disable cookies in their browsers at any time in whole or in part in the settings. If cookies are deactivated, not all functions of the website may be available. For the analysis of the use of the website FS uses the Google Analytics service of the American Google Inc (hereinafter "Google"). In doing so, cookies, IP addresses and other data of the participants may be transmitted to Google. Further information on data protection in this context can be found in Google's privacy policy. For the newsletter dispatch, FS uses the Mandrill service of the American The Rocket Science Group LLC (hereinafter "Mandrill"). For this purpose, the email addresses of the participants, in particular, may be transferred to Mandrill. 3 Other provisions

By participating, participants acknowledge these conditions of participation and assign all rights of use and exploitation of the submitted texts, images, and videos to FS without any restrictions in terms of time, space, and content. Should individual provisions of these conditions of participation be invalid or void, this shall not affect the validity of the remaining provisions of these conditions of participation. An invalid or void provision shall be replaced by a legally permissible provision that comes as close as possible to the original economic purpose. In the event of violations of these conditions of participation - also in the event of corresponding suspicion - FS may exclude participants from participation and subsequently withdraw and reclaim prizes from the prize draw. The participation is subject to Swiss substantive law exclusively and in its entirety - subject to mandatory statutory provisions. The exclusive place of jurisdiction is Zurich.
